Terms of Service

1. Agreement

By subscribing to or using Ask Essie ("the Service"), you agree to these Terms of Service. Ask Essie is operated by Atlas UX LLC. If you do not agree, do not use the Service.

2. The Service

Ask Essie is an AI-powered answering service that handles inbound phone calls on behalf of your business. The Service includes:

• AI voice agent that answers calls using your business name
• Call summaries delivered via SMS
• Appointment booking with calendar integration
• SMS confirmations to callers
• Message taking and callback routing

3. AI Disclosure

Ask Essie uses artificial intelligence to handle calls. Callers will be informed they are speaking with an AI assistant. While our AI is designed to be helpful and accurate, it may occasionally misunderstand requests or provide imperfect responses. You acknowledge that AI-handled calls may not match the quality of a trained human receptionist in all situations.

4. Your Account

You are responsible for:

• Providing accurate business information during onboarding
• Keeping your phone number and account details current
• All activity that occurs through your account
• Ensuring your use complies with applicable laws in your jurisdiction

5. Subscription & Billing

The Service costs $99 per month, billed monthly through Stripe. Your subscription begins when you complete payment. See our Payments & Billing page for full billing details.

6. Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. There are no cancellation fees. After cancellation, call forwarding should be removed from your phone to avoid failed calls.

7. Acceptable Use

You agree to use the Service only for lawful business purposes. See our Acceptable Use Policy for full details. We reserve the right to suspend or terminate accounts that violate our acceptable use policy.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described in that policy.

9. Uptime & Availability

We aim for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

10. Limitation of Liability

Ask Essie is provided "as is." To the maximum extent permitted by law:

• We are not liable for missed calls, incorrect bookings, or miscommunication by the AI agent
• We are not liable for lost revenue, lost customers, or business damages arising from use of the Service
• Our total liability is limited to the amount you paid for the Service in the preceding 3 months

11. Indemnification

You agree to indemnify and hold harmless Atlas UX LLC, its officers, and employees from any claims arising from your use of the Service, including claims by your callers or customers.

12. Modifications

We may update these terms from time to time. Material changes will be communicated via email or SMS. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of the State of Missouri, United States. Any disputes will be resolved in the courts of Missouri.
